Overview

Welcome to ELDRYX.

The terms “we,” “us” and “our” refer to ELDRYX. ELDRYX is operated by Huzaifa Mooradun, trading as ELDRYX.

ELDRYX operates this online store and website, including all related information, content, features, tools, products and services, collectively referred to as the “Services.”

Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services to you.

These Terms of Service, together with any policies referenced in them, explain the rights and responsibilities that apply when you access or use the Services.

Please read these Terms carefully. They contain important information concerning orders, payments, production, delivery, returns, intellectual property, acceptable use, warranties and liability.

By accessing, browsing or using the Services, or by placing an order through our store, you agree to these Terms of Service and our Privacy Policy.

Where your express agreement is legally required, your use of the Services alone will not replace that requirement.

If you do not agree to these Terms or our Privacy Policy, you should not use the Services.

Nothing in these Terms excludes, restricts or modifies any mandatory consumer right that cannot lawfully be excluded, restricted or modified.

Section 1 — Access and Accounts

By using the Services, you confirm that you are at least the age of majority applicable in your place of residence.

A parent or legal guardian may allow a minor dependant to use the Services under their supervision where legally permitted.

To browse the store, create an account or place an order, you may be required to provide information such as your:

  • Name
  • Email address
  • Telephone number
  • Billing information
  • Payment information
  • Shipping address

You agree that the information you provide will be accurate, current and complete.

Where customer accounts are available, you are responsible for maintaining the confidentiality and security of your login credentials.

You are responsible for activity carried out through your account unless the activity occurred because of circumstances outside your reasonable control.

You must not sell, transfer, assign or license your account to another person.

Contact us promptly if you believe that your account or credentials have been accessed without authorisation.

We may require you to verify your identity before restoring access, changing account information or processing certain requests.

Section 2 — Products

We make reasonable efforts to provide accurate product descriptions, photographs, measurements, sizing information, material details and other product information.

However, colours and product appearance may vary depending on:

  • Screen calibration
  • Device settings
  • Lighting conditions
  • Photography
  • Production variation
  • The garment-dyeing or printing process

We cannot guarantee that the colour displayed on your device will exactly match the physical product.

Minor variations in print positioning, tone, texture, garment finish or measurements may occur within reasonable manufacturing tolerances. These variations do not necessarily constitute a defect.

Where a product is described as oversized, relaxed, garment-dyed, faded or made to order, those characteristics form part of the intended product design.

Please review the product description and size guide carefully before placing an order.

Product descriptions, prices and availability may be updated without prior notice.

We may discontinue products, restrict sales or limit purchase quantities where reasonably necessary, including because of availability, fulfilment capacity, legal restrictions or suspected unauthorised resale.

Nothing in this section limits your rights where a product is materially different from its description, damaged, defective or otherwise non-conforming under applicable law.

Section 3 — Orders

When you submit an order through our store, you are making an offer to purchase the products included in that order.

An automated order acknowledgement confirms that we received your order. It does not necessarily mean that the order has been accepted.

An order is accepted when:

  • Payment has been successfully authorised or processed; and
  • We confirm that the order can proceed to fulfilment.

We reserve the right to refuse, limit or cancel an order for legitimate reasons, including:

  1. Product or fulfilment unavailability
  2. Payment failure
  3. Suspected fraud or unauthorised activity
  4. Incorrect pricing or product information
  5. An incomplete or incorrect delivery address
  6. Shipping, sanctions or legal restrictions
  7. A technical or administrative error
  8. Quantities that reasonably appear intended for unauthorised resale

If we cancel an order after payment has been received, we will issue an appropriate refund to the original payment method.

Please review your products, sizes, colours, quantities, contact information and delivery address before submitting the order.

Because ELDRYX products may enter production shortly after an order is accepted, changes and cancellations cannot be guaranteed once fulfilment has begun.

Contact us as soon as possible if you need to request an order change or cancellation.

Submitting a request does not mean that the change or cancellation has been completed. We will confirm the outcome by email.

If we need to contact you regarding an order, we may use the email address, telephone number, billing address or delivery address provided during checkout.

Returns, refunds and applicable cancellation rights are governed by our Return and Refund Policy.

Nothing in this section limits any mandatory consumer rights that apply to your purchase.

Section 4 — Prices, Payments and Billing

Prices, discounts and promotions may change without prior notice.

The price charged for a product will be the price displayed and confirmed when the order is submitted, except where there is an obvious pricing or technical error.

Prices may include or exclude applicable taxes depending on the destination, store configuration and applicable legal requirements.

Any shipping charge, tax or other fee collected by us will be displayed during checkout before the order is submitted.

International orders may also be subject to customs duties, import taxes, brokerage fees or handling charges imposed by the destination country or carrier.

Unless checkout expressly states that these charges are included, charges imposed after importation are generally the responsibility of the recipient, except where applicable law provides otherwise.

Available payment methods are displayed during checkout.

Payments are processed through third-party payment providers. Their services may also be governed by their own terms and privacy notices.

You agree to provide accurate and complete payment, billing and account information.

By submitting payment information, you confirm that:

  1. The information is accurate and complete.
  2. You are authorised to use the selected payment method.
  3. The payment provider is authorised to process the transaction.
  4. You will pay the total amount displayed during checkout.
  5. You will not knowingly submit fraudulent or unauthorised payment information.

A payment authorisation may be declined, delayed or reviewed by the payment provider.

We are not responsible for a payment provider’s independent decision to decline or restrict a transaction, but we will assist with order-related information where reasonably possible.

Where an obvious pricing error occurs, we may contact you to confirm whether you wish to purchase the product at the correct price.

We will not charge the corrected amount without your approval. Where the order cannot proceed, any amount already collected will be refunded.

Promotions may be subject to separate eligibility rules, start and end dates, exclusions or quantity limits.

Where promotional terms conflict with these Terms solely in relation to the promotion, the specific promotional terms will apply.

Section 5 — Shipping and Delivery

We ship to supported international destinations.

Available destinations, delivery methods and shipping charges are displayed during checkout.

We may be unable to deliver to certain countries, territories, regions or addresses because of:

  • Carrier limitations
  • Fulfilment availability
  • Legal or sanctions restrictions
  • Customs limitations
  • Product restrictions
  • Circumstances outside our reasonable control

ELDRYX garments are produced after an order is placed.

Production time and shipping time are separate.

Most orders require approximately 2–5 business days for production before dispatch. Production may take longer because of product availability, seasonal demand, fulfilment delays or circumstances outside our reasonable control.

Delivery estimates displayed through the store, checkout, order confirmation or tracking service are estimates rather than guaranteed delivery dates, except where applicable law or an express agreement provides otherwise.

Delivery may be affected by:

  1. Production delays
  2. Carrier disruption
  3. Customs processing
  4. Public holidays
  5. Severe weather
  6. Incorrect or incomplete delivery information
  7. Labour disruption
  8. Local delivery conditions
  9. Events outside our reasonable control

Tracking information will be sent by email when it becomes available.

Tracking information may take additional time to update after a shipping label is created.

Products within the same order may occasionally be produced or shipped separately. An order may therefore arrive in multiple packages with different tracking numbers or delivery dates.

You will not be charged an additional shipping fee merely because we divide an accepted order into separate packages.

You are responsible for providing a complete and accurate delivery address.

Contact us immediately if you identify an error in your delivery details. We may be able to correct the address before fulfilment progresses, but changes cannot be guaranteed.

Additional delivery charges may apply if a package must be sent again because:

  1. An incorrect or incomplete address was provided.
  2. The recipient did not collect the package.
  3. Delivery was refused.
  4. Required customs charges were not paid.
  5. The carrier returned the package for a reason attributable to the recipient.

Where tracking states that a package has been delivered but it cannot be located, you should:

  1. Confirm that the delivery address is correct.
  2. Check the surrounding property and safe delivery locations.
  3. Ask household members, neighbours or building management.
  4. Contact the delivery carrier.
  5. Contact ELDRYX if the package remains missing.

Each missing-package report will be reviewed using the available tracking, carrier and delivery information.

A “delivered” tracking status does not automatically establish entitlement to a refund or replacement, but it also does not limit any protection available under applicable law.

Risk of loss or damage passes to you when the product is delivered into your physical possession or the possession of a person you identified to receive it, except where applicable law provides otherwise.

Section 6 — Intellectual Property

The Services and their content are owned by or licensed to ELDRYX and are protected by applicable intellectual property laws.

Protected content may include:

  • Brand names
  • Trademarks
  • Logos
  • Slogans
  • Written material
  • Product names
  • Product designs
  • Artwork
  • Photography
  • Graphics
  • Video
  • Audio
  • Website layouts
  • Visual systems
  • Campaign concepts
  • Software and code

You may access and use the Services for personal, lawful and non-commercial purposes.

Unless expressly permitted by law or authorised by us in writing, you must not:

  1. Reproduce or republish ELDRYX content.
  2. Modify or create derivative works from protected content.
  3. Sell, resell or commercially exploit any part of the Services.
  4. Download or systematically store protected content.
  5. Copy product artwork, slogans or designs.
  6. Remove copyright, trademark or ownership notices.
  7. Use ELDRYX materials to suggest an unauthorised association, partnership or endorsement.
  8. Use automated tools to scrape, extract or reproduce store content.
  9. Register confusingly similar names, domains, social-media handles or brand identifiers.

Nothing in these Terms transfers ownership of any intellectual property to you.

The ELDRYX name, logo, product names, designs, slogans and other distinctive brand elements may be trademarks or protected brand assets.

You must not use them commercially without prior written permission.

Shopify’s names, logos, products and other brand assets belong to Shopify or its licensors.

Other third-party names, trademarks and content remain the property of their respective owners.

Section 7 — Optional Tools and Features

We may provide access to tools, applications, integrations or features operated by third parties.

We may not control or monitor every aspect of these third-party services.

Third-party tools may be provided on an “as available” basis and may be subject to separate terms, privacy notices, fees or eligibility requirements.

Before using a third-party tool, you should review the applicable provider’s terms and privacy practices.

Your use of an optional third-party service is at your discretion.

Nothing in this section excludes responsibility that cannot lawfully be excluded.

We may introduce, modify or discontinue tools, features or resources through the Services.

Any new feature made available through the Services will also be subject to these Terms unless separate terms are provided.

Section 8 — Third-Party Links

The Services may contain links to websites, applications, payment services, social-media platforms or other resources operated by third parties.

A link does not necessarily mean that ELDRYX endorses or controls the third party.

We are not responsible for the availability, accuracy, content, privacy, security or practices of third-party services that we do not control.

Before providing information or entering a transaction through a third-party service, you should review its terms and privacy policy.

Your dealings with an independent third party are between you and that third party.

This section does not exclude responsibility for representations expressly made by ELDRYX or liability that cannot lawfully be excluded.

Questions or complaints concerning an independent third party’s services should generally be directed to that provider. We may assist with information relating to an ELDRYX order where reasonably possible.

Section 9 — Relationship With Shopify

Our online store is hosted by Shopify.

Shopify provides the ecommerce infrastructure used to make the Services available.

Products purchased through the ELDRYX store are sold by ELDRYX, not by Shopify.

ELDRYX is responsible for the products it sells, its descriptions, customer service, order fulfilment, policies and compliance obligations.

Shopify may provide technical, payment, analytics, security or other platform-related services.

To the extent permitted by law, Shopify is not a party to the sales contract between you and ELDRYX merely because Shopify hosts the store.

Nothing in this section limits any independent obligation Shopify may owe to you under applicable law or under a separate service you receive directly from Shopify.

Section 10 — Privacy

Our collection and processing of personal information are governed by our Privacy Policy.

Because Shopify hosts the store, Shopify may collect and process information relating to your access to and use of the Services.

Information submitted through the Services may also be transmitted to service providers involved in:

  • Payment processing
  • Product fulfilment
  • Shipping
  • Analytics
  • Marketing
  • Fraud prevention
  • Customer support
  • Website operation

Some providers may process information in countries other than the country in which you reside.

You retain ownership of original content contained in your Feedback.

By submitting Feedback directly to ELDRYX or through an ELDRYX review feature, you grant us a non-exclusive, worldwide, royalty-free licence to:

  • Use
  • Reproduce
  • Publish
  • Display
  • Adapt
  • Translate
  • Distribute
  • Share

the Feedback for the purpose of operating, improving and promoting ELDRYX and its products.

This licence applies only to the extent permitted by applicable law and does not permit us to process your personal information inconsistently with our Privacy Policy.

You confirm that:

  1. You own the Feedback or have permission to submit it.
  2. The Feedback reflects your honest experience or opinion.
  3. The Feedback does not violate another person’s rights.
  4. The Feedback is not unlawful, deceptive, defamatory, abusive or malicious.
  5. You have disclosed any payment, gift, discount or incentive received in connection with the Feedback.

We are not required to publish, maintain, compensate or respond to Feedback.

We may decline to publish or may remove Feedback that:

  • Violates these Terms
  • Is unrelated to the product or service
  • Contains personal or confidential information
  • Contains spam or promotional material
  • Is fraudulent or misleading
  • Violates applicable law
  • Infringes another person’s rights

We will not manipulate reviews in a manner that unlawfully misleads consumers.

Section 12 — Errors, Inaccuracies and Omissions

Occasionally, information available through the Services may contain typographical errors, technical errors, inaccuracies or omissions.

We may correct or update inaccurate information where reasonably necessary.

Where an error affects an order that has already been submitted, we may contact you with the correct information and ask whether you wish to proceed.

We will not charge a higher corrected amount without your agreement.

Where an order cannot reasonably proceed because of an obvious error, we may cancel it and refund any amount collected for that order.

Nothing in this section permits us to change a concluded consumer contract unlawfully or limits a mandatory remedy available to you.

Section 13 — Prohibited Uses

You may use the Services only for lawful purposes.

You must not use or attempt to use the Services:

  1. For an unlawful, fraudulent or malicious purpose.
  2. To violate any applicable law or regulation.
  3. To infringe intellectual property, privacy or other legal rights.
  4. To harass, threaten, abuse, defame or unlawfully discriminate against another person.
  5. To submit false, deceptive or misleading information.
  6. To upload, transmit or distribute viruses, malware or malicious code.
  7. To conduct phishing, spam or unauthorised solicitation.
  8. To impersonate another person or entity.
  9. To collect or track personal information without lawful authority.
  10. To interfere with the operation, availability or security of the Services.
  11. To bypass access controls, rate limits or security measures.
  12. To scrape, crawl or systematically extract store content without permission.
  13. To place fraudulent orders or conduct unauthorised payment activity.
  14. To reproduce, resell or commercially exploit the Services without permission.
  15. To use the Services in a way that materially harms ELDRYX, Shopify, our service providers or other users.

We may investigate suspected violations and take reasonable action, including restricting access, cancelling fraudulent orders or reporting unlawful conduct to the appropriate authorities.

Any action we take will remain subject to applicable law and mandatory consumer rights.

Section 14 — Suspension and Termination

We may suspend or terminate access to all or part of the Services where reasonably necessary, including where:

  1. You materially violate these Terms.
  2. We reasonably suspect fraud or unlawful activity.
  3. Your activity creates a security or operational risk.
  4. Continued access would violate applicable law.
  5. You misuse an account, payment method or store feature.
  6. The Services or a relevant feature are discontinued.

Where reasonably possible and legally permitted, we will provide notice of the suspension or termination.

Termination does not affect rights, obligations, orders or amounts that arose before termination.

Suspension or termination of website access does not remove any obligation to fulfil an accepted order or provide a refund where required.

Sections that are intended by their nature to continue after termination will remain in effect, including provisions concerning:

  • Intellectual property
  • Privacy
  • Payment obligations
  • Feedback licences
  • Liability
  • Enforcement
  • Dispute resolution

Section 15 — Warranties and Availability

We make reasonable efforts to keep the Services accurate, operational and secure.

However, access may occasionally be interrupted because of:

  • Technical problems
  • Network outages
  • Third-party service disruption
  • Security incidents
  • Events outside our reasonable control

We do not guarantee that every website feature will always be available or free from minor technical errors.

Except for guarantees, warranties or rights that cannot lawfully be excluded, the Services are provided on an “as available” basis.

Products remain subject to all statutory guarantees and conformity requirements applicable to the purchase.

Nothing in these Terms excludes, restricts or modifies any mandatory right, guarantee, warranty or remedy that cannot lawfully be excluded, restricted or modified.

Section 16 — Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

ELDRYX remains responsible for losses that are a foreseeable result of our breach of these Terms or failure to exercise reasonable care and skill, where applicable law requires that responsibility.

To the fullest extent permitted by law, we are not responsible for losses that:

  1. Were not reasonably foreseeable when the relevant agreement was formed.
  2. Resulted from inaccurate information provided by the customer.
  3. Resulted from unlawful or unauthorised use of the Services.
  4. Were caused solely by circumstances outside our reasonable control.
  5. Relate to commercial or business use where the product was purchased solely for personal use.

We do not exclude or limit liability for:

  • Fraud or fraudulent misrepresentation
  • Death or personal injury caused by negligence
  • Deliberate misconduct
  • Breach of mandatory consumer rights
  • Defective products where liability cannot lawfully be excluded
  • Any other liability that applicable law does not permit us to exclude or limit

Nothing in this section prevents you from seeking a remedy expressly available under our Return and Refund Policy or applicable consumer law.

Section 17 — Responsibility for Misuse

To the extent permitted by applicable law, you are responsible for reasonably foreseeable losses directly caused by:

  1. Your fraudulent, malicious or unlawful use of the Services.
  2. Your material breach of these Terms.
  3. Your infringement of another person’s intellectual property or legal rights.
  4. Harmful activity knowingly carried out through your account.
  5. Information or content you submit without the necessary rights or permission.

This section does not require an individual consumer to compensate ELDRYX for losses caused by:

  • ELDRYX
  • Shopify
  • Our service providers
  • A product defect
  • Circumstances outside the consumer’s reasonable control

Nothing in this section limits any protection available under mandatory consumer law.

Section 18 — Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to make it enforceable where legally possible.

Where it cannot be made enforceable, the affected portion will be treated as severed.

The remaining provisions will continue in effect unless the removal of the affected provision makes the agreement incapable of operating as intended.

Section 19 — Waiver and Entire Agreement

A failure or delay by ELDRYX in exercising a right under these Terms does not automatically waive that right.

Any waiver must be clear and applies only to the specific circumstance for which it was given.

These Terms, together with the policies and any specific terms presented during checkout, constitute the agreement governing your use of the Services and your purchases from ELDRYX.

Where there is a conflict:

Before commencing formal proceedings, we encourage you to contact us so that we can attempt to resolve the matter fairly.

This section does not require a consumer to bring a claim in a jurisdiction where doing so would unlawfully restrict their rights.

Section 22 — Headings and Interpretation

Section headings are included for convenience and do not limit the meaning of these Terms.

Words in the singular may include the plural and words in the plural may include the singular where the context requires.

The words “including,” “include” and similar expressions mean “including without limitation,” unless the context requires otherwise.

Where these Terms are available in more than one language, translations may be provided for convenience.

Where legally permitted, the English version will be used to resolve inconsistencies between translations. This does not limit any right arising from mandatory language requirements.

These Terms should be interpreted in a fair and reasonable manner consistent with applicable consumer law.

Section 23 — Changes to These Terms

The current version of these Terms will be available on this page.

We may update these Terms to reflect changes to:
